Redlich's Work Injury Lawyers have recently assisted an injured Victorian to access damages for the consequences of injuries she sustained to her back whilst at work.
The worker was employed in an administrative role which often required moving boxes and other awkward items. She noted an increasing level of pain in her back until her condition rapidly deteriorated and she collapsed at work. The Plaintiff was unable to return to work after this time.
Andrea Tsalamandris made an application on behalf of the worker to the Victorian WorkCover Authority for a certificate acknowledging that the worker had suffered a serious injury and could pursue compensation for her lost earnings and pain and suffering. The application was rejected, and the matter was heard before His Honour Judge Misso in the County Court.
In his judgment delivered in June 2014, His Honour found that the worker had suffered a serious injury and was entitled to pursue lump sum compensation. In particular, he found that the worker's inability to return to work represents a significant loss and that her injury could be described as very considerable .
The finding allows the worker to make a claim for compensation from her former employer for the impact of the consequences on her life, as well as the income she has lost as a result of her injury.
