Redlich's Work Injury Lawyers has assisted an injured Victorian worker access compensation for injuries he sustained as a result of his employment.
The worker was injured after he was struck by a reversing vehicle at his workplace. The collision caused a severe injury to his knee, requiring a number of surgical investigations and treatment. A claim for compensation under the WorkCover system was lodged and accepted by his employer's insurance company.
Andrea Tsalamandris from Redlich's Work Injury Lawyers made an application on the worker's behalf for compensation for his pain and suffering, and his loss of earnings. The initial application for recognition of the severity of the worker's injury was rejected by the WorkCover authority, and a certificate was awarded by the County Court in August 2013.
The parties were unable to agree on an appropriate amount of compensation for the level of suffering the worker had been through, as well as the impact on his capacity to earn an income. As a result, the matter proceeded before a jury in the Supreme Court in May 2015.
The jury returned a verdict of $200,000 for his pain and suffering, as well as $350,000 for income he lost in the past, and a further $350,000 for income he will continue to lose into the future.
