Redlich's Work Injury Lawyers have helped an injured Victorian worker access compensation for the pain and suffering she has endured as a result of her workplace injury.
The worker was employed as a teacher who suffered a head injury as a result of her employment. Unfortunately, she did not recover from the effects of the trauma, and experiences ongoing pain, as well as a reduction in her memory and concentration. These consequences continue to affect her ability to engage in activities of daily living.
Redlich's Work Injury Lawyers made an application to the Victorian WorkCover Authority on the basis that her injury satisfied the serious injury test and she was entitled to seek lump sum compensation. The application was rejected by representatives of the Victorian WorkCover Authority and the matter was referred to the County Court for determination.
In her judgment delivered in October 2014, Her Honour Judge Lawson overturned the decision of the VWA, and found that the injured worker did in fact satisfy the definition of serious injury under the legislation. The finding entitles the worker to pursue a claim for compensation against her former employer.
