Our client worked as a meat process worker for a number of years. Whilst undertaking various physically demanding duties, she sustained an injury to her shoulder which prevented her from returning to work and performing her usual activities. In addition to her new physical limitations, the consequences of this injury also had a profound psychological impact upon our client.
Penny Flint lodged an application seeking recognition from the Victorian WorkCover Authority that our client had sustained a serious injury, which was rejected. County Court proceedings were issued and the matter was heard before His Honour Judge Misso in late July 2013.
In delivering his findings, His Honour found that our client's psychiatric condition had clearly deteriorated as a result of her physical restrictions, and particularly when further treatment was of no benefit. In His Honour's opinion, our client had been overpowered by her psychiatric condition and this prevented her from returning to any form of employment in the foreseeable future.
His Honour's findings mean that our client is now entitled to pursue pain and suffering damages, as well as compensation for lost earnings.
