The TAC has released a new set of guidelines for lawyers representing people injured in traffic accidents in Victoria. The new protocols, prepared in conjunction with a group of personal injury law representatives, are designed to replace the current guidelines that have been in place for 11 years. They apply across a number of fields, including disputes regarding medical expenses and weekly payments for lost wages, the assessment of an injured person's entitlement to a lump sum benefit, and the process of applying for pain and suffering and economic loss compensation. The purpose of the new protocols is to ensure that both parties engage in pre-litigation negotiations and attempt to resolve disputes and claims without the need to go to court wherever possible.
