Redlich's Work Injury Lawyers recently obtained a settlement for a disability support worker who was injured at work when she physically supported a client in her care during the client's seizure.
The worker sustained permanent injuries to her neck and shoulder. Though she attempted to continue working, her injuries and associated pain were substantial and ultimately forced her to stop working in her previous role.
Despite disability support staff recognising and reporting changes in the client's condition that posed risks, the employer was negligent in not appropriately responding to the issue and ensuring the safety of employees. The case was able to settle without going to Court. Redlich's Work Injury Lawyers successfully secured a six-figure sum on behalf of the worker for her pain and suffering.
The case illustrates the need for disability service providers to ensure safe environments for their workers. This includes regular training on how and when to physically support clients, and having appropriate numbers of workers on duty at all times.
The case also highlights the need for disability service providers to accommodate the changing physical needs of their clients to ensure that workers are not put in danger when tending to them. This may include having a one-on-one support worker for a client who is recognised to have more significant needs.
