Our client was subjected to aggressive behaviour by students, including threats of physical violence, which led to a psychological injury. She also suffered a physical injury to her back as a result of malfunctioning equipment on the school premises. Our client underwent significant treatment for her back injury including nerve blocks and injections.
As a result of both her psychological and physical injury, our client was unable to return to her employment as a teacher. She managed to retrain and return to alternative employment in a part time capacity.
Whether our client had suffered economic loss to the required legislative standard was hotly contested, and we were ultimately able to obtain damages for both economic loss and pain and suffering for our client without proceeding to court.
