Worker injured in unique circumstances receives compensation under the TAC scheme

Redlich’s Work Injury Lawyers recently resolved a common law claim under the TAC scheme for a worker injured in unique circumstances.

Our client was driving between jobs in her role as an in-home support worker, when she was involved in a motor vehicle accident. She collided with a motorcycle, suffering physical and psychological injury. The motorcycle rider absconded from the scene, meaning the circumstances of the accident were unclear. 

As she sustained her injury in the course of her employment, she was entitled to receive weekly payments and medical and like expenses, along with an impairment benefit under the WorkCover scheme. However, in proceeding with a claim for negligence, she was required to make a Serious Injury application in accordance with the TAC legislation.

We were able to resolve the claim for our client without the need to issue court proceedings.
