Many of us attend the gym for the purposes of keeping fit and staying healthy. Unfortunately however, a handful of us get injured in the process. Gym injuries can happen due to a range of different reasons. Some common ones include:
- Slips and trips;
- Injuries caused by improperly maintained and/or faulty gym equipment and;
- Poor advice provided by gym instructors and trainers.
In Victoria, gym operators are required to ensure that their premises are safe for gym users. If you are injured as a result of an unsafe gym, you are entitled to at a minimum, compensation for your out of pocket medical expenses and/or loss of earnings during the time that you were unable to work because of your injury. If you have suffered an injury or loss to the required standard under the law, you are also entitled to 'pain and suffering' damages in addition to the above. Adults have three years to commence proceedings from the date of injury, so it is important that proper legal advice is received promptly.
